Privacy StatementRustico Ltd and Gulfstream Restaurant Ltd (“we,” “our,” “us”) are committed to protecting your privacy and ensuring that your personal information is handled in accordance with the Personal Information Protection Act 2016 (PIPA) of Bermuda.

1. Scope

This Privacy Statement applies to:

  • Employees and job applicants whose personal information we collect for recruitment, employment, and HR purposes.

  • Customers and guests who interact with us through reservations, bookings, dining services, or inquiries.

2. Personal Information We Collect

We may collect the following types of personal information:

  • Employees and job applicants: name, contact details, date of birth, identification documents, work permit and immigration information, emergency contacts, banking details, tax and payroll information, medical/health certificates where required by law, performance records, and training records.

  • Customers and guests: name, phone number, email, booking details, payment information, dietary requirements or special requests.

3. Purpose of Collection and Use

We collect and use personal information only for legitimate business purposes, including:

  • Fulfilling employment, HR, payroll, health insurance, pension, and immigration obligations.

  • Managing restaurant operations, including reservations, seating, billing, and customer service.

  • Meeting our legal and regulatory obligations under Bermuda law.

  • Communicating with staff and customers about employment or reservations.

We do not use personal information for unrelated purposes without your consent.

4. Sharing of Information

We may share personal information only where necessary with:

  • Government authorities (e.g., Department of Immigration, Social Insurance, Health Insurance).

  • Payroll processors, accountants, and insurers.

  • Service providers (e.g., IT, reservations, website, POS systems) who support our operations.
    All third parties are required to protect personal information in line with PIPA.

5. Retention of Information

We retain personal information only as long as necessary for the purposes for which it was collected and to comply with legal obligations:

  • Employee and payroll records: 7 years after termination of employment.

  • Immigration and work permit records: 7 years after expiry or termination.

  • Reservation/customer records: 12 months after the booking, unless longer retention is required for legal, regulatory, or dispute resolution purposes.

  • Marketing communications: until you unsubscribe or for up to 2 years of inactivity.

6. Security Safeguards

We use physical, electronic, and administrative safeguards to protect personal information against loss, theft, unauthorised access, or misuse. Access is limited to staff and service providers who need the information for legitimate business purposes.

7. Your Rights

Under PIPA, you have the right to:

  • Request access to your personal information.

  • Request correction or update of inaccurate or incomplete data.

  • Request that we stop using your personal information in certain circumstances.

  • Request deletion of your information, subject to legal or regulatory requirements.
